- INTRODUCTION - DEFINITIONS
These general terms and conditions aim to define the conditions and terms of operation and use of the iMAGI-X service made available to the Client upon the acquisition of an iMAGI-X control box, as described in Article 3 below. The Client will be informed of any modifications to the Terms of Use when connecting to the Service.
It is specified that the terms and expressions beginning with a capital letter, whether used in the singular or plural, shall, for the purposes of these General Terms of Use, have the meaning set forth below, or the meaning indicated in bold within the body of these terms.

- PRESENTATION OF PISCINES MAGILINE
Piscines MAGILINE is the owner of the iMAGI-X application, which can be downloaded on smartphones and tablets through the online stores of various operating system publishers (notably the Apple Store and Play Store).
Piscines MAGILINE is the Technical Administrator (the “Technical Administrator”) of the customer accounts opened by each Customer in the customer area of the iMAGI-X Application.
The e-mail address, in its capacity as Technical Administrator, is webmaster@magiline.fr . All communications made in connection with the use of the Service are carried out by e-mail unless otherwise provided for in these Terms of Use.
Piscines Magiline is solely the Technical Administrator of the Customer Account through its IT department.
All other relationships generated by the use of the Service, whether commercial, technical, or otherwise, are solely the responsibility of the Customer with the Reseller and/or the pool Installer, as the case may be.
The iMAGI-X application is the property of the company Piscines MAGILINE, a simplified joint-stock company (SAS) with share capital of €1,103,800, having its registered office at 3 rue du Labourat – ZI des Ecrevolles, in Troyes (10000), registered with the Troyes Trade and Companies Register under number 439 450 933 000 23, represented by Mr. Hervé Ricard, President.
The hosting provider of the solution is OVH, SAS with share capital of €10,000,000 – RCS Roubaix–Tourcoing 424 761 419 00045 – APE Code 6202A – VAT No.: FR 22 424 761 419 – Registered office: 2 rue Kellermann 59100 Roubaix – France.
The iMAGI-X Service allows the use of the intelligent filtration box used for the control and remote management of certain pool equipment. The Service requires at least one electrical box, the iMAGI-X Box, installed on the Customer's pool, which is connected using equipment chosen by the Customer. The iMAGI-X Box transmits a number of data and commands to the iMAGI-X smartphone application.
The iMAGI-X Service gives the Customer the ability to access the iMAGI-X Application in order to:
- consult remotely certain information relating to different parameters linked to the use of the pool, notably the Pool Data,
- remotely control the start-up and adjustment of devices installed in the pool,
- send messages to the Reseller of the pool, who is part of the Piscines Magiline dealer network,
- invite users (family members, tenants, etc.) to access the iMAGI-X solution.
Access to the iMAGI-X Service is open to any user wishing to create an account. However, only Customers who own a pool equipped with an iMAGI-X Box installed by an authorized Reseller can benefit from all the features.
Access to the Service is free of charge and grants the Customer a right of access to a personal space reserved for them on the smartphone application that the Customer may choose to download (“the Application”). This space is intended to allow them to perform the operations listed above (the “Customer Account”).
To create a Customer Account, simply download the iMAGI-X Application and follow the registration procedure.
- Customers who own a pool equipped with an iMAGI-X Box must complete their registration using the unique code printed on their iMAGI-X Box.
- Guests may create an account without a code and benefit from limited or general features.
To access the iMAGI-X Service, the Customer must:
- own a pool equipped with the iMAGI-X Box, properly connected,
- have accepted these Terms of Use upon their first connection to the mobile application and, where applicable, have accepted the updates to the Terms of Use, of which they will be informed upon connecting to the Service.
- have been approved by confirmation sent by e-mail from the Technical Administrator confirming the creation of their Customer Account,
- have carried out, following receipt of the confirmation of creation of their Customer Account, a test that they have deemed satisfactory regarding the proper functioning of the iMAGI-X Service.
To access the iMAGI-X Service, the Guest must:
- have accepted these Terms of Use upon their first connection to the mobile application and, where applicable, have accepted the updates to the Terms of Use, of which they will be informed when connecting to the Service,
- have been approved by confirmation sent by e-mail from the Technical Administrator of the creation of their Customer Account and by the communication of their login and password to access their Customer Account.
- have carried out, following receipt of their login and password, a test that they have deemed satisfactory regarding the proper functioning of the iMAGI-X Service.
- Scope of the Service
This article details the services included and the services excluded from the scope of the Service.
The parameters that can be consulted and/or modified remotely are those displayed on the iMAGI-X Application dashboard, namely in particular: the filtration system, pH, RedOx, and water temperature (the “Parameters”). The Parameters are detailed in the User Guide provided to the Customer prior to the acquisition of the iMAGI-X Box.
The pool devices and accessories whose operation and settings can be controlled remotely include, in particular, those related to water filtration, heating, projector lighting, and accessories powering comfort equipment (the “Devices”).
It is expressly reminded that none of the pool’s safety devices or equipment can be remotely controlled due to applicable regulations and standards.

- Excluded Services

The iMAGI-X Service expressly does not have the purpose or effect of allowing the Customer to:
- remotely control the safety equipment of their pool,
- directly check the proper functioning of the pool’s equipment, devices, and accessories,
- directly detect anomalies or malfunctions of said Devices,
- directly detect errors or anomalies in the information obtained on the Account.
As a general rule, the Customer is expressly reminded that neither the use of the iMAGI-X Box nor the use of the Application can replace the installation of safety equipment whose presence may or may not be required by law. The Customer remains solely responsible for the choice of safety equipment installed on their pool, and no request may be made to Piscines Magiline in this regard within the scope of the Service.
Furthermore, the iMAGI-X Service cannot constitute or generate, even implicitly, any service complementary or additional to the simple right of access to the Customer Account.
The Technical Administrator and the Reseller, if authorized to consult the Pool Data as detailed in Article 6.3, even if they are aware of the information and operations carried out by the Customer on their Account, do not, on their own initiative, exercise any control over the functioning of the Customer’s pool Devices, nor do they exercise control over the Pool Data obtained by the Customer when consulting their Customer Account and/or over the use made of this Data by the Customer. Interventions by the Technical Administrator and the Reseller will only be made at the express request of the Customer.
In no way can the iMAGI-X Service replace insurance, a maintenance or monitoring service, or a service of recommendations, advice, or information.
- TECHNICAL PREREQUISITES
The use of the iMAGI-X Service by the Customer and the performance that can be expected from it specifically require:
- that all the pool Devices necessary to achieve such performance are present in the pool, in perfect working order, compatible, and properly connected to the iMAGI-X Box,
- that the Box has been installed by a MAGILINE-certified technician or the Reseller, who has received specific training,
- that the Customer and the Reseller strictly comply with the instructions set out in the iMAGI-X Box User Guide,
- that the pool’s surrounding environment, due to the Customer’s installations or geographical configuration, does not electrically or otherwise interfere with the detection of the pool Devices used for information consultation or command execution.
The Customer is personally responsible for the rental or adaptation of the equipment they have chosen to connect to their Customer Account and for the software usage rights they employ for this purpose. They must ensure, under their own responsibility, the compatibility of their equipment with the Service. No warranty, even implied, is granted regarding the operation of the Service with all existing terminals.
The Service consists of and is limited to providing the Customer with access to a Customer Account within the iMAGI-X Application, with the Customer connecting using the equipment of their choice, via compatible communication channels (notably wired Internet or Wi-Fi).
Piscines Magiline is therefore not involved in any dispute that may arise between the Customer and the supplier of their equipment, nor in any dispute relating to the use of the Customer’s fixed or wireless communication networks and their access providers.
Piscines Magiline is also not responsible for any direct or indirect damages that may result from a Customer’s connection to their Account.
The Service and its functions, including the mobile/tablet application that the Customer may download, and the process for accessing the Customer Account may evolve during their use by the Customer. In the event of such changes, an information message for the Customer will appear during their first connection following the modification.
Subscription to the iMAGI-X Service follows its own rules and provides a service to the Customer that is distinct and independent from other services that the Customer may otherwise have contracted with the Reseller or any other professional party.
At any time, the Technical Administrator may decide to carry out a maintenance operation, which will result in the unavailability of the Service for a certain period of time. A communication will be sent to all active Customer Accounts.
Access to the iMAGI-X Service and the Customer Account is protected by a personalized security system consisting of a login and a personal and confidential code assigned by the Technical Administrator when the Customer acquires the Box. Any access to the Service and the Customer Account necessarily requires the use of the confidential code.
This personalized security system is under the custody of the Customer, who is solely responsible for it. Its use is deemed to be strictly personal and places sole responsibility on the Customer.
In case of loss of their confidential code, the Customer may request that the Customer Account be blocked from the iMAGI-X Application, or by sending a request to the Technical Administrator’s address ( webmaster@magiline.fr ). The Customer Account will be blocked upon receipt of the information, and the sending of a new code can only take place at the Customer’s request.
The Customer has the ability to change their password at any time and must do so in particular in case of loss, use, or suspected use by an unauthorized third party of their personalized security system.
The Technical Administrator has the right to block the Service for reasons related to the security of the Application, to the use or suspected fraudulent use of the Customer Account, and to the maintenance of the Service. They will immediately inform the Customer, indicating the reasons for the blocking if security conditions permit.
The Technical Administrator will restore access to the Service as soon as the reasons justifying the blocking no longer exist.
- Privacy Policy, Data Sharing

- Consultation by the Customer
The Customer is the only one who can activate and deactivate their Customer Account, except as provided in Article 5. The Customer is also the only one who can manage and, where applicable, modify the information on the Parameters, as well as the start-up and adjustment of the Devices.

- Consultation by the Technical Administrator
The Customer’s access to the Service and the opening of the Customer Account necessarily implies that the Technical Administrator has access to the Customer’s Pool Data. The history of this information is kept in compliance with the Privacy Policy.
Consequently, when the Customer accesses the Service, they expressly acknowledge being informed that said Pool Data may be used by Piscines Magiline as part of the analysis of malfunctions of the iMAGI-X Box, and that such data may reveal any use not in compliance with the User Guide provided by Piscines Magiline.
In order to achieve optimal use of the iMAGI-X Box, Pool Data may be transmitted to the Reseller if the Customer consents.
If accepted, the Pool Data will be visible to the Reseller, who will then be able to view Danger Notifications. The Reseller may contact the Customer to propose a solution. This intervention will fall under the maintenance contract if the Customer has subscribed to one with their Reseller. In the absence of such a contract, the Reseller will only be required to propose a solution to the Customer at the Customer’s express request. If the Customer agrees to share Pool Data, they expressly acknowledge being informed that such data may be used by the Reseller for the purpose of analyzing malfunctions of the iMAGI-X Box, and that such data may reveal any use not in compliance with the User Guide provided by Piscines Magiline. Furthermore, if the Customer accepts to share Pool Data with the Reseller, the latter may propose to the Customer, in the event of a malfunction of the Box, to carry out a remote diagnosis by means of a video call made via the Application. To do so, the Customer must accept the Reseller’s invitation and authorize the start of the call.
Please note that if the Customer refuses to share Pool Data, the Reseller will not have access to any Pool Data and Danger Notifications will not be transmitted to them. It will then be solely the responsibility of the Customer to manage their pool and their Notifications, and to take the appropriate measures.
The Customer may change their choice to share or not share Pool Data with their Reseller at any time from their personal space within the iMAGI-X Application.
It is reminded that, in accordance with the consent given by the Customer upon signing the order form, by default, Pool Data sharing is enabled, and it is up to the Customer, upon their first connection to the Service, to change this choice from their Customer Account.
- CHOICE OF NOTIFICATIONS
Danger Notifications are mandatorily sent to the Customer by email at the address used to create the iMAGI-X Customer Account. They are issued when a function is blocked or stopped (the “Danger Notifications”). During the configuration of the Application, the Customer will be offered the option to also receive these Danger Notifications via notification on their mobile phone.
The Customer may accept or refuse to receive on their phone the notifications issued by the iMAGI-X Application as Danger Notifications.

- Warning Notification
Warning Notifications are sent by email on an optional basis to the address used to create the iMAGI-X Customer Account. Warning Notifications relate to a non-blocking malfunction (the “Warning Notifications”). During the configuration of the Application, the Customer will be offered the option to also receive these Warning Notifications via notification on their mobile phone.
The Customer may accept or refuse to receive by email and/or on their phone the notifications issued by the iMAGI-X Application as Warning Notifications.
It is specified that neither Danger Notifications nor Warning Notifications create any obligation for Piscines Magiline, which remains solely the Technical Administrator of the iMAGI-X Application.

- Geolocation
The use of the iMAGI-X Application requires the activation of WIFI and/or Bluetooth by the Client. The Client is informed that these activations necessarily involve the collection of certain geolocation personal data.
In addition, certain Notifications require the activation of the Client's mobile phone geolocation. As this also concerns personal data, the Client's consent will always be requested before geolocation is activated, and the Client will remain free not to authorize the iMAGI-X Application to access the location of his/her mobile phone.
Any refusal may, in some cases, prevent the use of certain functions.
- USE OF DATA
This possibility of consulting Pool Data is solely intended to:
- Allow the Technical Administrator to perform his role as Technical Administrator,
- Allow the Reseller to make suggestions or recommendations, provide advice and/or make commercial offers to the Client.
In no way does this possibility of accessing Pool Data:
- Impose on the Technical Administrator or the Reseller any duty or obligation of intervention,
- Impose on the Technical Administrator or the Reseller any obligation to analyze the Pool Data,
- Nor, in general, even if the Reseller analyzes the collected information, have the purpose or effect, whether explicitly, implicitly or indirectly, of entitling the Client to expect or claim to be informed of anomalies or malfunctions that may occur on the Devices, or to be warned or advised of ways to remedy such anomalies or malfunctions, unless expressly requested and within the framework of a service contract to be mutually agreed with the Reseller.
The Client remains solely responsible for taking the initiative to interpret the Pool Data collected, or to request interpretation from a professional, and for verifying whether such information is inaccurate.
- RESPONSIBILITIES
The Client accepts the Service provided in its current state of operation and performance. The Client therefore accepts the risks resulting from the limitations of the Internet and its use, as well as from defects in network reliability.
The iMAGI-X service is limited to granting the Client access rights to his/her Client Account.
The Client is therefore solely responsible for the information collected on his/her Account, for its interpretation and use. The Client is also solely responsible for the commands given to his/her Devices and for their proper execution by the Devices.
The accuracy, consistency and reliability of the information collected by the iMAGI-X Control Unit, as well as the proper execution of commands by the Devices, also depend on and are subject to strict compliance with the requirements indicated in Article 3.1 General Presentation of the iMAGI-X Service above. It is therefore recommended that the Client regularly ensure, on site at the pool location, the proper working condition of his/her equipment and Devices, strictly comply with the instructions provided in the iMAGI-X Control Unit User Guide, and verify that the configuration of the pool’s location does not interfere with the transmission and reception of information and remote commands.
It is the Client's responsibility to remedy any anomaly or malfunction observed on the equipment and Devices, to carry out all necessary repairs, and to make any modifications or replacements required, by contacting his/her Reseller.
It is also the Client's responsibility, where applicable, to invoke the manufacturer's warranty on the equipment or Device that has proven to be defective.
It is the Client's responsibility, if deemed necessary, to conclude any maintenance contract with a specialized company of his/her choice and to subscribe to any insurance policy of his/her choice.
Piscines Magiline cannot be held liable in the event of maintenance interrupting the Service, in the event of circumstances beyond the Technical Administrator's control preventing the proper operation of the Service, in the event of accidental transmission of viruses, in the event of technical problems related to the malfunction of pool equipment and Devices, or in the event of failure affecting telephone or electrical networks.
- NO WARRANTIES
In view of the above, Piscines Magiline does not grant any warranties of any kind on the Service, except for legal warranties that may be required by law. No additional commercial warranty is granted by Piscines Magiline.
In particular, Piscines Magiline:
- Does not guarantee the Client continuous, uninterrupted, or secure access to the Service.
- Does not grant the Client any warranty, even implicit, regarding the consistency, accuracy, reliability, completeness, relevance, or efficiency of the Pool Data collected by the Control Unit, nor regarding the result obtained in relation to the commands sent to the Devices based on, or not, the information available in the Client Account.
- CHANGE OF POOL OWNERSHIP
In the event of transfer of the Client's pool to a third party, the Client may not transfer the benefit of his/her membership to the transferee. The Client must inform the Technical Administrator without delay so that the latter can close the Client Account.
The Client may inform the transferee of the existence of the Service offered by the iMAGI-X Control Unit. If the transferee wishes to benefit from the Service, he/she must contact Piscines Magiline to request the creation of a new Client Account.
- DEPARTURE OF THE RESELLER FROM THE MAGILINE NETWORK
If the Reseller leaves the Magiline network, and in order for the Client to continue being in contact with a Reseller using the iMAGI-X Application, the Client may request by email from Piscines Magiline the identity of a Reseller to whom he/she may transfer his/her Pool Data. The Client may then inform the Technical Administrator whether he/she wishes to authorize said Reseller to access the information contained in his/her Account. In such case, the Technical Administrator will transmit to the newly authorized Magiline Reseller the history of the information contained in the Client Account.
- INTELLECTUAL PROPERTY
Piscines Magiline is the owner of the Application. The Application and its components are protected by copyright law.
The Client does not acquire any ownership rights over the software. He/she is granted the right to use the software on a non-exclusive basis for personal use and in accordance with the documentation provided.
The Client may not rent, lend, or transfer rights to the software to a third party.
The Client may not modify, reproduce, adapt, distribute, publish, or translate the software. He/she may also not disassemble, decompile, or attempt to recreate any source code derived from the software.
- DURATION AND SUSPENSION OF THE SERVICE - REMOVAL OF OPTION
The Client may cease using the Service at any time and request the closure of his/her Client Account from the Technical Administrator.
Piscines Magiline may only restrict the Client's access to the Service in cases of abnormal behavior by the Client regarding the access rights granted, irregularity, abuse, or serious misconduct in the use of the Service, malfunctions, damage, or repeated errors in handling the Service system. Such termination will be notified to the Client and results in the deletion of his/her Client Account and the withdrawal of access rights to the Service.
The Technical Administrator may also, without terminating the Client's membership but after notifying him/her, suspend access to the Service for security reasons by blocking the Client Account for as long as necessary to resolve the security issues.
- CONSUMER MEDIATION
In accordance with Articles L616-1 and R616-1 of the French Consumer Code, it is specified that in case of a dispute regarding the use of the Service, the Client may initiate a mediation process with the consumer mediator to whom Piscines Magiline is subject. PERSONAL DATA PRIVACY POLICY
PISCINES MAGILINE – iMAGI-X
- Purpose of Processing (Objective and Legal Basis)
Piscines MAGILINE, whose registered office is located at 3 rue du Labourat - ZAC des Ecrevolles 10000 Troyes France (RCS Troyes 439 450 933), is the owner of the iMAGI-X application, which can be downloaded on smartphones and tablets. Piscines MAGILINE is hereinafter sometimes referred to as “We” or “Our”. The iMAGI-X service is a home automation system that enables remote control and operation of certain pool equipment (the “Service”). The Service uses an electrical unit, the iMAGI-X Control Box, installed on the Client’s pool, which is connected via equipment chosen by the Client. The iMAGI-X Control Box transmits a number of information and commands when using the iMAGI-X smartphone application.
On this occasion, data are recorded and processed in a client file.
The information collected in this file is necessary to:

Provide the iMAGI-X Service by storing the data and making it available to clients for consultation. It also enables Piscines MAGILINE to:
- Send alerts to clients in case of malfunction,
- Act in the event of fraudulent use of a client account.

Carry out marketing operations (loyalty, promotions) and:
- send personalized advertisements by email, SMS, and postal mail to clients who have consented (i) on products similar to those they have ordered, (ii) on other products offered by the company.
- Transmit the data of our clients who have consented to Piscines MAGILINE’s business partners, to allow them to send advertisements.
- Manage and dynamically maintain commercial relationships with clients.
- Legal bases for processing
- Service management: the legal basis for processing is consent (see Article 6(1)(a) of the EU General Data Protection Regulation), consent given by the client when creating his/her client account in the iMAGI-X mobile application.
- Sending commercial solicitations by email regarding products similar to those ordered by clients: the legal basis for processing is the company’s legitimate interest (see Article 6(1)(f) GDPR), namely promoting Piscines MAGILINE products to clients.
- Sending commercial solicitations by email regarding other products offered by the company: the legal basis for processing is consent (see Article 6(1)(a) GDPR).
- Transmission of the email address to business partners: the legal basis for processing is consent (see Article 6(1)(a) GDPR).
- List of data collected
When creating the Client Account, the following information is collected:
- Identity: email address, title, last name, first name, phone number, address (latitude and longitude), language, time zone.
When using the iMAGI-X application, the following information is collected:

Pool Data:
- Name and address (latitude and longitude) of the pool;
- Water and air temperature, pH value, Redox value;
- Pool statistics: water volume, treatment time, filtration time, product consumption;
- Additional information: pool shape, filtration block position, location, vegetation, sun exposure, usage, pool photos (stored securely, with the possibility of deletion at any time);
- Equipment configurations: control box, camera, smart speaker, installed accessories, etc.;
- List and operating status of equipment;
- Event history: actions carried out on the pool, intelligence-related events, notification history;
- Intervention history: Chemical readings of the water (pH, Free chlorine, Total chlorine, Combined chlorine, Calcium hardness, Total alkalinity, Cyanuric acid, Copper, Iron, Phosphate, Salt), Product additions (Chlorine, pH, TAC, Shock chlorine, Cyanuric acid, Other), Refilling, Water meter readings, Cleaning (filter, vacuum, robot), Assessments (water quality rating, pool photo, comment).
- Other data: IP address, customized accessory names, video call history (no video call recordings are stored by PISCINES MAGILINE), network configuration.
- Use of data by third parties
The iMAGI-X customer service and the sales department of Piscines MAGILINE are recipients of all categories of data.
The reseller of the iMAGI-X Control Box, if the client consents, will be the recipient of the client’s identity and Pool Data.
Email addresses of clients who have consented are made available to our business partners (list of business partners, regularly updated).
- Data retention period
- Pool Data
The data are retained as long as the client uses the Service.
At the end of the use of the Service, and if there is no other reason to continue processing, the information will be retained for five (5) years, in particular in application of the applicable limitation rules, or where appropriate, for the purpose of handling any claim or request related to the services provided.
- Data necessary for loyalty and marketing activities
Customers' personal data are retained for the duration of the use of the Service plus 3 years for marketing and prospecting purposes, without prejudice to retention obligations or statutory limitation periods.
